1a. You remain the owner of any materials (video, pictures, text) you
send to us.
1b. You agree to only post your videos and not videos owned by someone
else.
1c. By sending us your materials (video, pictures, text) you agree to
allow us to display your material for a minimum of 6 months.
2a. We accept videos only in AVI (.avi), MPEG-1 and MPEG-2 (.mpg or .mpeg), QuickTime (.mov), Macromedia Flash (.swf), Real Media (.rm) or Windows Media (.wmv) format.
2b. We reserve the right to refuse or shorten your video material
without explanation.
2c. We reserve the right to add the XSpasm logo on your video material.
3. All information in your profile is confidential unless otherwise
indicated. We will not sell or otherwise make public any of your
confidential information.
4. All references to dollars or $ and all receipt or payments of monies
to be made pursuant to this agreement shall be made in lawful currency
of United States, except where expressly stated otherwise.
5a. XSpasm.com offers no warranty, limited or otherwise, on any of its services. XSpasm.com advises any user to immediately notify us on the
discovery of any major failure of its services.
5b. Under no circumstances will XSpasm.com be liable for any lost
profits, lost savings, any incidental damages, or any consequential
damages arising out of the use or inability to use its services, even if
XSpasm.com has been advised of the possibility of such damages.
6. This Agreement has been entered into and delivered and shall be
construed in accordance with, and governed by, the laws of the Province
of British Columbia and the laws of the Dominion of Canada applicable
therein.
